Federalism and the Controversy Over the New Media in West Germany

Abstract

The possibilities of expanding the television network by means of cable and satellite service have paved the way for the Länder to determine relevant organizational structures. The newly completed State Media Treaty seems to represent a definite breakthrough in regulatory policy. The legal regulation of the new media—cable and satellite television—faces further complications, however, insofar as nine Land media laws impose different legal requirements on the new broadcasters. Even so, differences among the Länder in the area of cable TV are no longer as great as they were in the past, and a satellite agreement reached by the Länder provides for more uniform regulation. Also, the Federal Constitutional Court's 1986 decision emphasizing the importance of a uniform system of broadcasting and requiring dual private and public broadcasting may have settled the fundamental political dispute among the Länder over the new media.
